Hishaw, hereinafter referred to as defendant, was charged in the District Court, Oklahoma County, Case No. CRM-76-2018, with the offense of Possession of Marijuana, in violation of 63 O.S. 1971 ? 2-402 [63-2-402]. He was tried by a jury, convicted and sentenced to a term of one (1) year in the Oklahoma County Jail. From this judgment and sentence the defendant has perfected a timely appeal to this Court.
